Rights and ownership of your uploaded content

From a legal standpoint, the key concerns in these Terms and Conditions that would require close attention, especially around ownership of content, are outlined below:

1. Ownership of Intellectual Property Rights
Enso's Ownership of Contributions: The Terms state that all content you submit (referred to as “Contributions”) is automatically considered "works made for hire" for Enso. This means Enso will own the intellectual property rights to the Contributions, including any modifications, enhancements, or derivatives of that content.

Transfer of Rights: By participating, you agree to assign all rights, title, and interest in the content to Enso. This includes moral rights, and they also specify that you waive any claims for royalties or compensation related to the use of your Contributions.

Impact on Your Ownership: The biggest issue here is that you relinquish ownership of any content you submit, making it difficult to claim future rights or control over your work. This could be problematic if you want to retain ownership or use your Contributions outside of this relationship with Enso.

Action Item: If you are concerned about retaining ownership of your work, consider negotiating the terms or seeking clarification about specific rights to your content.

2. License to Enso for Your Content
Enso’s Usage Rights: Enso grants itself an irrevocable, perpetual, royalty-free license to use your content in virtually any way it deems fit, including storing, reproducing, modifying, and distributing it for the maintenance and improvement of the Services. While this is common in many service agreements, it limits your control over your own content, as Enso can exploit it without compensation.

Action Item: If this broad usage is a concern, you may want to request a more limited license that preserves your control over certain uses of your content.

3. Feedback and Contributions
Ownership of Feedback: Enso also states that any feedback you provide is owned by them, and they are not required to provide compensation or credit for it. This means that any ideas, suggestions, or improvements you offer could be used by Enso without any obligation to you.

Action Item: If you plan on providing feedback, be aware that this will become Enso’s intellectual property.

4. Termination of Rights
Termination Without Cause: Enso reserves the right to terminate the agreement and your access to the Services at any time, which may affect your ability to use or access your content in the future. This could create uncertainty if you rely on Enso’s platform for visibility or content distribution.

Action Item: You may want to ask for clarity on the termination terms, especially regarding your intellectual property and content usage post-termination.

5. Liability and Indemnification
Indemnity Clause: You are required to indemnify Enso for any claims, losses, or damages arising from your use of the Services or contributions. This is a common clause but could expose you to financial risk if your content or actions lead to legal disputes.

Action Item: Make sure you understand the potential risks and legal obligations involved with indemnification. You may wish to negotiate the terms of indemnification or ask for specific exclusions.

6. Governing Law and Jurisdiction
Jurisdiction: The terms specify that disputes will be handled under Israeli law, with jurisdiction in Tel Aviv. If you are based outside Israel, this could present logistical challenges or additional legal complexity should a dispute arise.

Action Item: If this jurisdiction is an issue, you may want to negotiate a different jurisdiction more favorable to your location.

Key Takeaways:
Loss of Content Ownership: Enso will own your Contributions, meaning you lose any future rights or control over them.

Broad Usage Rights: They hold an extensive license to use, modify, and distribute your content indefinitely.

Indemnification: You may be required to indemnify them, which could expose you to financial risk.

Termination Rights: Enso can terminate your access and rights at any time, leaving your content potentially vulnerable.

Governing Law and Jurisdiction: Disputes will be handled under Israeli law, which may be inconvenient if you're located elsewhere.

If your primary concern is retaining exclusive rights to your content, you should revisit the ownership and licensing clauses, seek clarification, and potentially negotiate a more restrictive license for Enso’s use of your content. You may also consider legal counsel to help ensure your intellectual property rights are protected in this agreement.

Thank you for sharing your experience, and we’re genuinely sorry to hear you were disappointed. We strive to be as clear as possible about our free trial policy, which does require a credit card for activation due to security and anti-fraud reasons—this is a standard practice across many platforms, but we understand it can be frustrating.

We’d never want anyone to feel unsupported or blocked for sharing their feedback. If your comment was removed, it may have been flagged in error or due to automated moderation. We sincerely apologize for any misunderstanding and would love the opportunity to address your concerns directly.

Enso offers nothing of value

Enso offers nothing of value and immediately removes anyone who exposes anything about their site. It's fake and presents itself as a "data broker with extra steps".

Their website uses fake testimonials.

Content moderation
We never remove comments because they are critical. We do, however, moderate for spam, personal attacks, or private information that violates community guidelines. If a legitimate comment was taken down in error, please provide the link or screenshot and we will restore it promptly.

Open invitation to verify
We offer a sandbox environment and a 14-day trial (credit-card required to prevent bot abuse). You can inspect the product, run your own tests, and export all data you create. Should you remain dissatisfied, contact support@enso.bot and we will cancel the trial and purge your data within 24 hours.
